General Terms and Conditions for Consumers
1. Scope
These General Terms and Conditions apply to contracts between
Alexander Konzack, trading as AK-Motion
Weinbergstr. 14
91452 Wilhermsdorf
Germany
– hereinafter referred to as the “Seller” –
and consumers who order goods, digital content or services through this online shop.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
2. Contracting Party and Contact Details
The contract is concluded with:
Alexander Konzack, trading as AK-Motion
Weinbergstr. 14
91452 Wilhermsdorf
Germany
Telephone: +49 170 2245754
Email: info@ak-motion.com
3. Conclusion of the Contract
The presentation of products and services in the online shop does not constitute a legally binding offer, but an invitation to place an order.
You may initially place products in the shopping cart without obligation. Before submitting your order, you can review your entries and correct them using the correction options provided.
By clicking the final order button, which clearly indicates that the order entails an obligation to pay, you submit a binding offer to conclude a contract for the products or services contained in the shopping cart.
After we receive your order, you will receive an automatic acknowledgement by email. This merely confirms receipt of the order and does not constitute acceptance unless the email expressly states that the order has been accepted.
We may accept your offer within five days:
- by sending an express order confirmation by email;
- by dispatching the goods ordered;
- by making the digital content ordered available;
- by commencing the agreed service; or
- by requesting or processing payment.
The earliest of these events determines the time of acceptance. If we do not accept your offer within this period, you are no longer bound by it.
4. Contract Languages and Storage of the Contract Text
The languages available for concluding the contract are displayed in the online shop.
After the order has been placed, the order details and these General Terms and Conditions will be provided to you on a durable medium, in particular by email. The current version of these Terms and Conditions can be accessed, saved and printed from the online shop.
If you have a registered customer account, the essential order details may also be viewed in your customer area.
5. Prices and Shipping Costs
All prices shown are total prices in euros and include statutory value added tax.
Any additional shipping costs are displayed in the shopping cart and before you submit the binding order. Further information is available on the “Shipping and Returns” page.
6. Payment
The payment methods currently available are displayed during checkout.
Unless otherwise stated for a particular payment method, the total amount is due immediately upon conclusion of the contract.
7. Delivery of Goods
We deliver to the countries and regions that can be selected during checkout.
The applicable delivery time is stated on the product page or during checkout. If an order contains several items with different delivery times, the items may be delivered together or in separate shipments.
Partial deliveries are permitted where reasonable for you. You will not incur additional shipping costs as a result.
If delivery is not possible for reasons for which you are responsible despite a further reasonable delivery attempt, you may be charged the reasonable additional costs thereby incurred. This does not apply if you are not responsible for the circumstances or if you validly exercise your right of withdrawal.
8. Digital Content
Digital content is supplied in the manner described on the relevant product page, for example by download link or through a customer account.
If you have expressly consented to performance beginning before the expiry of the withdrawal period and have acknowledged that you thereby lose your right of withdrawal once performance begins, the digital content may be supplied immediately after conclusion of the contract or payment.
Your statutory rights in respect of defective digital products remain unaffected.
9. Services
The nature and scope of a service are determined by the relevant service description and the agreements made during the ordering process.
If the service is to begin before the withdrawal period expires, we will obtain the express declaration required by law.
For a paid service contract, the right of withdrawal expires only once the service has been fully performed, provided that all statutory requirements have been met.
10. Retention of Title
Goods remain our property until payment has been made in full.
11. Right of Withdrawal
Consumers have the statutory right of withdrawal. Details are set out in our separate Cancellation Policy and Model Withdrawal Form.
12. Statutory Rights in the Event of Defects
Statutory rights in respect of defects apply.
In the event of defective goods, you are entitled in particular to the statutory remedies of subsequent performance and, where the statutory conditions are met, a price reduction, termination of the contract and damages.
You do not have to present the original invoice in order to exercise your statutory rights. Other suitable proof of purchase is sufficient.
Any additional manufacturer’s warranties apply independently of, and do not limit, your statutory rights. Details are set out in the relevant warranty statement.
13. Applicable Law
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.
If you are a consumer habitually resident in another country, this choice of law does not deprive you of the protection afforded by mandatory consumer-protection provisions of that country.
14. Consumer Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
